The Gold Card Lifetime Limited Warranty applies to most
replacement radiators sold to consumers in the North American
aftermarket. Gold Card Warranty coverage is provided for replacement
radiators used in cars, light trucks, vans, and sport utility
vehicles.
The complete text of the Gold Card Lifetime Limited Warranty as it
appears in the Radiator Owner's Manual follows. A copy of this
manual is packed in the shipping carton with every automotive and
light-truck radiator sold in the United States and Canada. When you
purchase a Modine replacement radiator for your car, light truck,
van, or sport utility vehicle, be sure to ask your product source
for this six-page manual, and be sure to retain it.
Gold Card Lifetime Limited Warranty Text
This radiator is warranted against defects in material and
workmanship for as long as the original purchaser owns the vehicle
in which the radiator was originally installed. Any Gold Card
Service Center or other participating facility will replace any such
radiator in accordance with the terms of this warranty.
In the event of a failure due to a defect in material or
workmanship, the original purchaser shall be responsible only for
the cost of labor, antifreeze, and any additional parts required to
complete the installation at a Modine Gold Card Service Center or
other participating facility.
This warranty applies to most Modine radiators sold only in the U.S.
and Canada. No proof of maintenance is required. The warranty covers
the radiator and any parts of the radiator furnished from a Modine
factory. This warranty does not apply to any product that has been
repaired or altered in any way so as, in the judgment of Modine, to
affect its stability, nor which has been subject to misuse,
negligence or operating conditions in excess of those for which the
radiator was designed. This warranty does not cover the effects of
physical or chemical properties of water, steam, or other liquids or
gases used in the radiator. Also, the cost of labor, any additional
parts, and antifreeze required to complete the installation of a
replacement radiator are not covered by this warranty. If vehicle
coverage is discontinued, this warranty is void.
The proper radiator, as indicated in the Modine Radiator, A/C
Condenser and Heater catalog, must be installed in a mechanically
sound vehicle. This warranty does not apply to radiators that have
failed from external corrosion, including salt air corrosion in
coastal areas, during the first five years. This warranty does not
apply if the vehicle in which the radiator was installed was used in
commercial (including fleet), governmental, off-highway or racing
applications, or if the radiator installed was used as a component
in another manufacturer's product. If one of the conditions above
apply, refer to the alternate warranties included in this booklet.
If the radiator fails due to a defect in material or workmanship,
the defective radiator and the original purchase receipt must be
presented to a Gold Card Service Center or participating facility to
verify the cause of the radiator failure.
The replacement of the radiator shall be the sole and exclusive
remedy to which Modine Manufacturing is obligated and to which the
original retail purchaser is entitled. MODINE MANUFACTURING SHALL
NOT BE LIABLE FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES OF ANY
KIND RESULTING FROM THE ORDER OR USE OF ITS PRODUCTS. These damages
include reimbursement of the original purchase price, loss of the
use of the vehicle, loss of time or inconvenience, towing charges,
rental of a replacement vehicle and any other special, incidental,
consequential, or punitive damages.
MODINE'S WARRANTY OF THE GOLD CARD RADIATOR TO BE FREE FROM ALL
DEFECTS IN MATERIAL AND WORKMANSHIP AS LIMITED HEREIN SHALL BE IN
LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING
WARRANTIES OF MERCHANTABILITY AND FITNESS, AND ALL SUCH EXPRESSED OR
IMPLIED WARRANTIES ARE HEREBY DISCLAIMED.
THIS WARRANTY IS NOT TRANSFERABLE AND IS AUTOMATICALLY CANCELLED IN
THE EVENT THAT THE VEHICLE IN WHICH THE RADIATOR HAS BEEN INSTALLED
IS SOLD, LEASED OR OTHERWISE TRANSFERRED TO ANOTHER OWNER.
This warranty gives you specific rights, and you may also have other
rights which vary from state to state. Some states do not allow the
exclusion of incidental or consequential damages, so any such
limitation may not apply to you.
